Municipal leasing (lease-purchase) is
immediately available for government agencies, divisions and departments if
that government has power of eminent domain, taxing authority or police power.
That means agencies of states, cities and counties such as fire, police,
schools, public works, prisons, highway and roads, etc. can utilize municipal leasing
to acquire essential equipment exactly when they need it...which is usually
now.
The IRS has ruled that interest income from
municipal leasing is not subject to Federal income tax, so investors that buy
the "paper" are able to charge much lower interest rates and still be
happy. (The income interest is also exempt from taxation in some states.)
Key to making a municipal lease work is a
"non-appropriation" clause inserted into the lease documents. This
clearly states that if, for any reason, funds to pay for the lease are not made
available in any subsequent fiscal year, the lease can be terminated. This
clause is put there because most jurisdictions do not allow creating an
obligation beyond the current fiscal year...unless bonds and voter approval are
involved. Therefore, the municipal lease allows funds to be used from current
operating budgets to acquire equipment through a lease-purchase finance
program. It also avoids the costly and time-consuming process of issuing bonds
and messing with voter approval.
Payments can be made in advance, in arrears,
monthly, quarterly, semi-annually or annually.
This is important: You select the
equipment and vendor. The vendor receives their full retail price and does NOT accept
financial recourse.
There is a minor amount of paperwork,
including a form accepting the equipment after it is shipped to you, but the
process is super simple and easy...actually a good example of K.I.S.S. at its
best.
Municipal leasing is, of course, available
anywhere in the United States, but it is also available in Canada and Mexico as
well as several other countries.
